Prosecutor asks Peña whether he knew of IPS out-of-court agreement

The Public Prosecutor’s Office asked President Santiago Peña whether he knew of and consented to an out-of-court agreement involving IPS. According to the report, the former legal director said in IPS board minutes that he had acted with the president’s direct approval; he is under investigation on suspicion of breach of trust and unlawful enrichment.

Prosecutor asks Peña whether he knew of IPS out-of-court agreement

The Public Prosecutor’s Office formally asked President Santiago Peña to tell the prosecutor whether he knew of and approved an out-of-court agreement involving the Social Security Institute (IPS). The request was made by prosecutor Christian Benítez as part of the investigation into the institute’s former legal director, José “José'i” González Maldonado.

González Maldonado is under investigation on suspicion of breach of trust and unlawful enrichment. According to the report, he received G. 412,500,000, including VAT, in fees for brokering an agreement between IPS and Consorcio Hotelero Sudamericano SA, represented by Jorge López Moreira. According to the report, the former legal director pressed for acceptance of G. 7,500,000,000, with an additional 5% allocated exclusively to professional fees; the final amount was G. 7,912,500,000.

According to the IPS board minutes cited in the report, the former legal director said he had acted with President Peña’s direct approval to finalize the out-of-court agreement.

The prosecutor’s letter asks Peña to provide information on whether he knew of and consented to the agreement between IPS and Consorcio Hotelero Sudamericano SA.
