Supreme Court Rejects Appeal by Company Linked to Lawmaker, Paving Way for Guaraní to Recover Bingo Guaraní Property

Paraguay's Supreme Court of Justice rejected an appeal filed by YEM SA, a company linked to Colorado lawmaker Yamil Esgaib, in the lawsuit brought by Club Guaraní to regain possession of the property where Bingo Guaraní operates. With the decision, the case returns to the Court of Appeals, and the club hopes for a final resolution after years of litigation.

Club Guaraní announced that the Supreme Court of Justice (CSJ) rejected the appeal filed by YEM SA, a company linked to Colorado lawmaker Yamil Esgaib, in the judicial proceedings initiated by the club to evict the occupant of the property where Bingo Guaraní operates. The decision, released in an official statement from the club, was seen as an important step toward recovering the property.

“With this decision, the case returns to the Court of Appeals, and the path is open for a ruling to be issued on the matter, in accordance with the law and with due speed,” the club said in a statement. The club emphasized that the process has dragged on for several years, preventing it from regaining physical possession of a property that belongs to it.

Club Guaraní has already obtained favorable rulings in two lower courts after years of litigation. Since then, the board has been demanding the completion of the procedures to return the land. “Club Guaraní reaffirms its confidence in the justice system and the institutions of the Republic, and will steadfastly defend its property and the rights that legitimately belong to it,” the statement added.

The property houses Bingo Guaraní, a gambling establishment that remains in operation. YEM SA, linked to Esgaib, had filed the appeal in an attempt to block the proceedings, but the Supreme Court rejected it.
