The Ministry of Labor, Employment and Social Security (MTESS) emphasized that work on national holidays must be paid at double the rate, reminding of the rule applied to the June 12 holiday and the upcoming one on June 22.
According to Article 234 of the Labor Code, anyone who works on a holiday is entitled to a 100% increase on their salary. Payment must be made in cash and cannot be replaced by a compensatory day off.
The MTESS highlighted that a holiday is a mandatory day of rest, but if the company decides to keep operations running, it must inform employees who are required to work and pay them double.
