The Criminal Chamber of the Supreme Court of Justice unanimously rejected the habeas corpus petition filed on behalf of Gianina García Troche, who is being prosecuted for alleged illicit drug trafficking, related crimes and money laundering. The ruling leaves her pretrial detention in place after the court found no legal defect in the measure.
The petition was filed by attorney Daniel Garcete, who argued that the detention had become unlawful because of delays in the judicial proceedings. Justices Manuel Dejesús Ramírez Candia, María Carolina Llanes and Luis María Benítez Riera, however, found no illegality in the deprivation of liberty.
García Troche is a defendant in the investigation identified as case No. 1,358/2022. The pretrial detention was initially ordered in Interlocutory Order No. 104, dated May 21, 2025, by an authority the Criminal Chamber deemed competent.
In its ruling, the justices stated that the maximum periods established under Paraguayan law for pretrial detention had not yet been exceeded. They also recorded that the court responsible had responded in due time to the incidents raised by the defense after a formal request for urgency was filed in December 2025.
The Court’s review was limited to the legality of the precautionary measure and does not constitute a conclusion on García Troche’s criminal responsibility for the facts under investigation. Upholding the detention means that she will remain subject to the proceedings while the responsible authorities continue advancing the case.
